Single Vehicle Crash and DWI Charge for Motorist Who Failed to Move Over
Exeter, New Hampshire – On May 30, 2022 at approximately 6:15 PM, troopers from the New Hampshire State Police Troop A Barracks along with officers from the Exeter Police department, and emergency medical personnel from the Exeter Fire Department, responded to a report of a single vehicle crash on Route 101 East near mile marker 124, just east of Exit 9 in Exeter.
Upon arrival, it was determined that Daniel Landry, Age: 45, Lynn, MA, was traveling eastbound on Route 101 when he drove off the roadway and into the center median, through the median guardrail, then crossed both westbound lanes of Route 101 before driving off the westbound side of the roadway and into the woods. Also in Landry’s vehicle was a minor child passenger. Both were transported from the scene to Exeter Hospital for treatment of non-life threatening injuries. No other vehicles were involved in this collision.
The crash remains under investigation and no charges have currently been filed. State Police is requesting that anyone who may have witnessed the crash to contact the investigating trooper, Trooper First Class Brian Gacek at Brian.F.Gacek@dos.nh.gov.
The right travel lane of Route 101 west was closed for approximately 45 minutes while Landry’s vehicle was recovered from the woods. During the recovery of Landry’s vehicle, a passing motorist nearly struck the investigating trooper’s cruiser while the trooper was seated inside his cruiser. The trooper located the motorist who nearly struck his cruiser and conducted a roadside investigation, which resulted in that operator being placed under arrest for Driving While Intoxicated (DWI).
The intoxicated driver was identified as Daianara Rosario, Age: 42, Manchester, NH.
Rosario faces an additional charge of Motorist Duties When Approaching a Highway Emergency, commonly referred to as the “Move Over” law. The law requires motorists maintain a reduced speed and move over when encountering a highway emergency such as a crash or a police traffic stop.
Rosario was released on personal recognizance bail and will have to appear in Brentwood Circuit Court on July 5, 2022, to answer her charges.
